Patience was convicted on Wednesday, 24th March 2021 by Masaka Grade One Magistrate, Ms. Christine Nantege for torturing her son on February 8, 2021.
This was after a video went viral which captured the woman brutalizing her five-year-old son with a cane, stamping on his head, and kicking him in the chest.
Mr. Natal Angwadya, the state prosecutor, had requested a deterrence sentence on the grounds that Uwimana is an ex-convict who was recently released from Kisoro Prison for attempted murder.
He further said the woman never showed any sign of regret over her actions while she was being prosecuted.
“Your worship, the act done by this woman is unforgivable. There is a need for this honorable court to send a clear message to the community that torturing innocent children is felonious,” he said.
“I pray that she is given a deterrent and custodial sentence, your worship,” he pleaded.
In her defense, Patience pleaded with the court, saying that she only acted out anger saying that she has been tagged as the “mother of a thief” since her son steals whatever he comes across.
”Your worship, my neighbors used to attack me, saying that I gave birth to a thief because he would allegedly steal everything he came across. I ask for forgiveness because I over reacted out of anger basing on what my neighbors reported to me,” she said.
However, the court said that the convict had no criminal records and had a duty to protect her son from harm. Since she pleaded guilty to the crime, she was sentenced to two years in prison.
The court also said that Patience has the right to seek an appeal if she is not satisfied with her sentence within 14 days.
